1. Overview

These Terms of Service (“Terms”) govern your purchase and use of website design and hosting services (“Services”) provided by IntentMesh LLC, operating as ElevatorConstructor Services (“we,” “us,” or “our”), through the website at services.elevatorconstructor.com.

By purchasing a Service, you agree to be bound by these Terms. If you do not agree, do not complete the checkout process.

2. Services Provided

We offer website design, development, and managed hosting packages tailored to elevator and vertical transportation companies. Each package tier (Foundation, Professional, Enterprise) includes a one-time setup fee and a recurring monthly hosting and maintenance fee, as described on our pricing page.

• Managed hosting on Cloudflare Pages infrastructure
• Ongoing maintenance and content updates per your tier
• Technical support as described for your tier
• Free listing on ElevatorConstructor.com (tier-dependent)

3. Payment & Billing

All payments are processed securely through Stripe, Inc. We do not store your credit card information on our servers. By completing checkout, you authorize Stripe to process your one-time setup fee and recurring monthly subscription.

• Setup fees are charged immediately upon checkout
• Monthly fees begin after your website launches and are billed on the same calendar day each month
• All prices are in USD and do not include applicable taxes
• Failed payment attempts will be retried per Stripe's standard retry schedule

4. 30-Day Money-Back Guarantee

We offer a 30-day money-back guarantee on the setup fee. If you are not satisfied with the initial design direction within 30 days of purchase, contact us at [email protected] for a full refund of the setup fee.

• The guarantee applies to the one-time setup fee only
• Monthly hosting fees are non-refundable but you may cancel anytime
• Refunds are processed back to the original payment method within 5-10 business days

5. Cancellation

You may cancel your monthly subscription at any time by emailing us. Upon cancellation:

• Your site remains live through the end of the current billing period
• No further monthly charges will be incurred
• We will export your content and assets upon request
• No long-term contracts or early termination fees apply

6. Content Ownership

You retain full ownership of all content you provide (text, images, logos, branding). We retain ownership of the underlying website code, design templates, and proprietary components. Upon cancellation, you receive:

• All your original content, images, and brand assets
• An export of your website content in a standard format
• Your domain name (if registered through us) transferred to you at no cost

7. Service Scope & Limitations

Our Services are limited to website design, development, and hosting as described in your selected tier. We do not provide:

• Domain name registration (though we can assist)
• Email hosting (we recommend Google Workspace or similar)
• Paid advertising management (Google Ads, social media ads)
• Legal, accounting, or business consulting services

8. Hosting & Uptime

Websites are hosted on Cloudflare Pages infrastructure, providing enterprise-grade performance, global CDN distribution, and automatic SSL certificates. While we strive for 99.9% uptime, we do not guarantee uninterrupted service and are not liable for downtime caused by third-party infrastructure providers.

9. Acceptable Use

You agree not to use the Services to:

• Publish illegal, defamatory, or harmful content
• Infringe on intellectual property rights of others
• Distribute malware or engage in phishing
• Misrepresent your business credentials or licensing

We reserve the right to suspend or terminate service for violations of this policy.

10. Limitation of Liability

To the maximum extent permitted by law, IntentMesh LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email. Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of the State of Florida, United States. Any disputes shall be resolved in the courts of the State of Florida.
